Acceptance of Terms
By accessing or using the services provided by 21st Century Lending ("Company," "we," "us," or "our"), you ("Borrower," "Client," "you," or "your") agree to be bound by these Terms of Service and all applicable laws and regulations.
Important Notice
By submitting a loan application or using our services, you acknowledge that:
- You have read and understood these terms
- You meet all eligibility requirements
- All information provided is accurate and complete
- You understand mortgage lending involves financial risk
- You agree to comply with all loan terms if approved
Our Services
Mortgage Loan Origination
- • VA loans for qualified veterans and military
- • Conventional loans for primary and secondary homes
- • NonQM bank statement loans for self-employed
- • First-time buyer programs and down payment assistance
- • FHA loans with flexible credit requirements
- • Refinancing and cash-out refinancing options
Advisory Services
- • Pre-qualification and pre-approval services

Service Limitations
We are a mortgage broker and loan originator. We do not:
- Provide legal, tax, or financial planning advice
- Guarantee loan approval or specific terms
- Service loans after closing (unless specifically arranged)
- Provide real estate brokerage services (separate DRE license)
- Offer investment advice or securities
Eligibility Requirements
General Requirements
- • Must be 18 years or older
- • Legal resident or citizen of the United States
- • Valid Social Security Number or ITIN
- • Verifiable income and employment
- • Acceptable credit history and score
- • Sufficient assets for down payment and reserves
- • Property must meet program requirements
- • Debt-to-income ratios within acceptable limits
Program-Specific Requirements
VA Loans:
Valid Certificate of Eligibility (COE) and military service requirements
First-Time Buyer Programs:
Homebuyer education completion and program-specific income limits
NonQM Loans:
Alternative documentation and higher reserves may be required
Application Process and Commitments
No Guarantee of Approval
Submission of a loan application does not guarantee approval. All loans are subject to:
- Credit approval and underwriting guidelines
- Property appraisal and acceptable condition
- Income and asset verification
- Satisfactory property title and insurance
- Compliance with all program requirements
Rate and Term Commitment
Interest rates and loan terms are subject to change without notice until a rate lock is obtained:
- Rate quotes are estimates valid for limited time
- Rate locks require completed application and acceptable credit
- Lock periods vary and may incur fees for extensions
- Final terms depend on underwriting approval
Application Fees
Third-Party Fees (Non-Refundable)
- • Credit report: $25-50
- • Appraisal: $400-800
- • Processing: $300-800
- • Underwriting: $400-1,200
Closing Costs
- • Title and escrow fees
- • Recording and transfer taxes
- • Prepaid interest and taxes
- • Homeowner's insurance
Your Responsibilities as a Borrower
Information Accuracy
You are responsible for providing accurate, complete, and truthful information:
- All financial information must be current and verifiable
- Employment and income details must be accurate
- Asset and liability information must be complete
- Property information and intended use must be truthful
- Update us immediately if circumstances change
Document Submission
- • Provide requested documents promptly
- • Ensure documents are legible and complete
- • Use secure methods for sensitive information
- • Notify us of any document discrepancies
Communication
- • Respond to requests within specified timeframes
- • Maintain current contact information
- • Review all documents before signing
- • Ask questions if terms are unclear
Legal Consequences of Misrepresentation
Providing false information on a loan application is a federal crime that may result in:
- Loan denial or immediate call for full payment
- Federal prosecution for mortgage fraud
- Fines up to $1,000,000 and/or 30 years imprisonment
- Civil liability for damages to lenders

Direct Damages
Our liability for direct damages shall not exceed the total fees paid by you for our services.
Consequential Damages
We shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, property appreciation, or opportunity costs.
Third-Party Actions
We are not responsible for actions or decisions of third parties including lenders, appraisers, title companies, or other service providers.
Note: Some states do not allow limitation of liability for certain damages. In such cases, our liability shall be limited to the maximum extent permitted by state law.
Governing Law and Dispute Resolution
Applicable Law
These terms are governed by the laws of the State of California and applicable federal regulations, including:
- Truth in Lending Act (TILA)
- Real Estate Settlement Procedures Act (RESPA)
- Equal Credit Opportunity Act (ECOA)
- Fair Housing Act
- California Finance Lenders Law
- California Real Estate Law
Dispute Resolution
1. Direct Communication
First attempt to resolve disputes through direct communication with Aditya Choksi.
2. Mediation
If direct communication fails, disputes may be resolved through mediation by a neutral third party.
3. Regulatory Complaints
Complaints may be filed with NMLS, California DRE, CFPB, or other appropriate regulatory bodies.
4. Legal Action
Legal disputes shall be resolved in the state or federal courts of California, Riverside County.
